Introduction
Versive, LLC (“Versive”) respects your privacy and is committed to protecting it by complying with this Privacy Policy (the “Policy”).
This Policy describes the types of information Versive may collect from users in the United States or that users in the United States may provide when using or interacting with the Versive Service (as defined below) and our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Policy applies to information Versive collects:
- Through your use of the Versive streaming service on any device, including both the guest and premium streaming options (the “Service Options”).
- Through your use of the Versive web portal as a Messenger.
- When you personalize your user experience.
- When you connect your Versive account with another application, including the applicable app store through which you downloaded the Versive streaming service.
- On or through the website or any page of the website under the following URL: versiveapp.com (the “Site”).
- In email, text, and other electronic messages between you and Versive through the Site or the Versive service.
- When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy.
- Through any other Versive services that include a link to this Policy, including other Versive websites, customer service, and community pages.
All of the above are collectively referred to as the “Versive Service.”
It does not apply to information collected by:
- Versive offline or through any means outside of the Versive Service, including any other Versive services or websites that have their own privacy policy; or
- Any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Site. This includes biometric information and other information collected by your devices operating system that may be used to sign in to the Versive Service and payment information provided by you to third party payment processors (whether or not accessed via the Versive Service).
Please read this Policy carefully to understand our policies and practices regarding your information and how Versive will treat it. If you do not agree with our policies and practices, your choice is not to use the Versive Service. By accessing or using the Versive Service, you agree to this privacy Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Versive Service after Versive make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
Children
The Versive Service is not intended for children under 13 years of age or whose age makes it illegal to process their personal information or requires parental consent to process their personal information (collectively, “Children”). No Child may provide any information to or on the Versive Service. Versive does not knowingly collect Personal Information from Children. If you are a Child, do not use or provide any information on the Versive Service or through any of its features, register on the Versive Service, make any purchases through the Versive Service, use any of the interactive or public comment features of Versive Service, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If Versive learns that Versive has collected or received Personal Information from a Child without verification of parental consent, Versive will delete that information. If you believe Versive might have any information from or about a Child, please contact us at contact@versiveapp.com.
Versive does not knowingly collect Personal Information from persons under the age of 16 years. California residents under 16 years of age are required to opt-in to the sale or sharing of their Personal Information and have the right to opt out of sales of their Personal Information or any sharing of their Personal Information for cross-context behavioral advertising at any time.
Information Versive Collects About You and How Versive Collects It
Types of Information Versive Collects
Depending on your Service Option, how you create your account, the country you are in, and if you use third-party services to sign in, Versive may collect several types of information from and about users of the Versive Service, which is necessary to ensure profile completeness, provide content recommendations, and provide premium access. This includes information:
- By which you may be personally identified, such as your name, postal address, city, state, country, username, and e-mail address, and any other identifier by which you may be contacted online or offline (“Personal Information”);
- That is about you but individually does not identify you, such as your preferences relating to religion and message topics; and/or
- About your internet or network connection (including your provider), the equipment you use to access the Versive Service, and usage details, including messages you have played, searches you have conducted, playlists you have created, your Service Option, your usage of premium features, and anonymous statistical data regarding your use of the Services.
How Versive Collects Information
We collect the information above through various methods, including:
- Directly from you when you provide it to us, respond to surveys on the Versive Service, or post it to the Versive Service, such as when you provide registration information for a premium account.
- Automatically as you access and navigate through the Versive Service, including through cookies and other tracking technologies.
- When you communicate with us by phone or through e-mail or other electronic messaging, such as contacting our help desk or providing us with feedback.
- From other third parties and third party systems.
Messenger Content
If you sign up for a Messenger user account, you also may provide information to be published, displayed, streamed, or otherwise distributed (hereinafter, “posted”) on public areas of the Versive Service, or transmitted to other users of the Versive Service or third parties (collectively, “Messenger Contributions”). Your Messenger Contributions are posted on and transmitted to others at your own risk. [Although Versive prohibits the unauthorized downloading or distribution of Messenger Contributions and employs commercially reasonable technological means to block Versive users or third parties from doing so], please be aware that no security measures are perfect or impenetrable. Additionally, Versive cannot control the actions of other users of the Versive Service with whom you may choose to share your Messenger Contributions. Therefore, Versive cannot and does not guarantee that your Messenger Contributions will not be received by unauthorized persons.
Information Versive Collects Through Automatic Data Collection Technologies
As you navigate through and interact with the Versive Service, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, usage details and patterns, and the functionality of the Versive Service on your device. Certain automatic data collection technologies allow us to keep your user session active even when the application is closed, allowing you to keep your place. Information collected automatically includes:
- Details of your visits to our Services, including date/time stamp, click stream data, traffic data, location data, logs, and other communication data and the resources that you access and use on the Versive Service.
- Information about your device and network connection, including your device ID, IP address, operating system, browser type and version, domain names, referring/exit pages, network connection type (such as wifi, 5G, or Bluetooth), network provider, network and device performance, language, information enabling digital rights management, devices on your wifi network which can connect to the Versive Service, devices your operating system makes available when connecting via Bluetooth, plugin, and installation, general location data, device sensor data, and Versive application version.
- Errors in the functionality of the Versive Service, including data logs related to the cause of such errors.
We do not collect Personal Data automatically, but we may tie this information to Personal Data about you that we collect from other sources or you provide to us.
The technologies we use for this automatic data collection may include:
Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your device. You may refuse to accept browser cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain parts of the Versive Service. Unless you have adjusted your settings so that it will refuse cookies, our system will issue cookies when you use the Versive Service.
Flash Cookies. Certain features of the Versive Service may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on the Versive Service. Flash cookies are not managed by the same settings as are used for browser cookies. For information about managing your privacy and security settings for Flash cookies, see Choices About How We Use and Disclose Your Information.
Web Beacons. Pages of the Versive Service and our e-mail or other electronic communications may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Versive, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, verifying system and server integrity).
Error Monitoring Software. The Versive Service may include software designed to identify when an error has occurred that affects the functionality of the Versive Service for a user. It does this by monitoring various usage details and data from the user’s device. Upon the identification of an error, the software may provide us with data logs to allow us to diagnose the error and fix any software issues.
Information Company Collects from Third Parties
We may receive personal information about you from third party platforms, networks, services and/or sites that you integrate with the Versive Service and combine that with information we collect through the Versive Service. For example, if you register through or otherwise grant access to a third-party site or service, such as Apple (e.g., to use your Apple ID to log in to the Versive Service) or Stripe (e.g., to purchase premium content or make donations), we may collect personal information that is associated with your third-party site account. The information we receive from these third-party sites is dependent upon that third party’s policies and your privacy settings on that third-party site. You should always review and, if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to the Versive Service.
We may collect analytics data, or use third-party analytics tools such as Google Analytics, to help us measure traffic and usage trends for the Services and to understand more about our users by monitoring aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our website. We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, which permit us to recognize and contact you across multiple devices.
Some advertising companies are members of the Network Advertising Initiative (“NAI”) or Digital Advertising Alliance (“DAA”). The NAI provides information regarding targeted advertising, the opt-out procedures of NAI members, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising. You may also want to visit the DAA’s website for more about targeted advertising and an opt-out for DAA-participating companies.
Mobile devices contain settings that may allow you to disable tracking advertising or analytics. If you are using an iOS-based device and do not want to receive advertisements personalized to you or your individual interests, you may be able to limit these advertisements by enabling “Limit Ad Tracking” on your iOS Device following the instructions provided by Apple. If you are using an Android-based device and do not wish to receive advertisements personalized to you, you can visit Google’s Ads Settings page from a browser on your Android-based device and make your choices there. In addition, the digital advertising industry has provided the ability for mobile users to register at AppChoices for their intent not to receive targeted advertising.
Please note, it is not possible to opt-out of all advertising on the Versive Service. Advertising allows the Versive Service to be delivered with limited ads at a generally lower subscription cost to you, or, with certain Versive Service such as through the free ad-supported subscription tier of Versive Service where available, at no additional subscription fee. Using any combination of the methods described here to opt-out of personalized or individually targeted advertising means only that you will receive ads that are not tailored to you as a unique individual. By continuing to access the Versive Service, you understand that even in light of your cookie settings and other opt-out choices, you will continue to receive ads, which may be delivered based on non-personalized information about the context or genre of the content to which you are listening, or the general demographic or behavioral interest profile of listeners of certain content. You may also receive ads that are delivered generally to anyone in a certain geographical region or based on aggregated or non-personal data.
Use and Disclosure of Your Information
How We Use Your Information
Without obtaining additional authorization from you or your authorized representative, Versive may use information that we collect about you or that you provide to us, including Personal Data, as described in this Policy. Permitted uses of information include uses:
- To present the Versive Service and Messenger Contributions to you.
- To provide you with information or services that you request from us, such as service requests.
- To fulfill any other purpose for which you provide it.
- To validate account information you have provided to us, including your age.
- To keep you informed about the Versive Service and Messenger Contributions in which you are or may be interested (either by your own indication or as determined by our data analytics).
- To provide you with notices about your user account and access credentials, including expiration and renewal notices.
- To notify you about changes to the Versive Service or Messenger Contributions, including new features and updates.
- To allow you to participate in interactive features on the Versive Service.
- To estimate our audience size and usage patterns and the audience size for individual Messengers and/or groups of Messengers.
- To store information about your preferences, allowing us to customize the Versive Service according to your individual usage patterns.
- To maintain your session after you close the Versive application and recognize you when you return to the Versive Service.
- To maintain, diagnose, troubleshoot, and improve the Versive Service and to develop new services or features.
- To protect our company, our affiliates, our customers, and our websites, and to comply with laws, regulations, court orders, or other legal obligations.
- To enforce the Terms of Use or this Privacy Policy, or to detect fraud or other criminal activity.
- To create aggregated or anonymized data sets that do not reasonably identify you directly as an individual (“De-Identified Data”), which, once de-identified, is no longer subject to this Policy.
- In any other way we may describe to you when you or provide the information.
[Versive may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though Versive does not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.]
Disclosure of Your Information
Without obtaining additional authorization from you, Versive may disclose De-Identified Data about our users and Messengers, and any other information that does not identify any individual, without restriction. This includes disclosures of general usage reports to Messengers. [General usage reports provided to Messengers may also include pseudonymized data about you, which is your data that is identified by a code rather than your name or other directly identifying information.]
Without obtaining additional authorization from you, Versive may disclose information that we collect about you or that you provide to us, including Personal Data, as described in this Policy. Permitted disclosures of information include disclosures:
- To our subsidiaries and affiliates.
- To contractors, service providers, and other third parties Versive use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which Versive disclose it to them. This includes our database hosting service provider(s) and payment processing vendor(s).
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Versive’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Versive about our users is among the assets transferred.
- To fulfill the purpose for which you provide it. [For example, if you give us an email address to use the “invite a friend” feature of the Versive Service, Versive will transmit the contents of that email and your email address to the recipients.]
- For any other purpose we may describe to you when you or provide the information.
Other Disclosures of Information
We may also disclose your information, including Personal Data:
- To comply with any court order, law, or legal process, including to respond to any law enforcement, government or regulatory request, including in connection with public health activities.
- To enforce or apply the Terms of Service or this privacy Policy, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.
Versive urges you to be careful about giving out information in public areas of the Versive Service. Publicly available data, such as your profile name, profile photo, public playlists, and other content you post to the Versive Service will always be publicly available (except to any user you have blocked).
Any use or disclosure of your Personal Data not listed in this Policy will be made only with your authorization unless we are permitted by applicable law to make such other use and disclosure, in which case we shall comply with applicable law. You may revoke your authorization, in writing, at any time unless we have taken action in reliance upon it. Written revocation of authorization must be sent to the address listed below (see Contact Information below).
Certain kinds of Personal Data may be subject to enhanced privacy protection under federal and state law. Certain of these enhanced privacy protections are described below (see State-Specific Disclosures below).
Your Rights with Respect to Your Information
Choices about Information you Provide to Us
You have the right to be informed of the Personal Data we process and how we process it. We inform you though this Policy, information provided to you as you use the Versive Service, and by answering questions when you contact us. Providing information to us is entirely voluntary; you are not required to provide any information. However, if you choose not to provide information to us, we may be limited in the services or functions that are available to you through the Versive Service. Specifically, if you choose not to provide information to us, you will not be eligible to participate in any Versive Service or to access any Messenger Content.
Accessing, Correcting, and Deleting Your Information
You can review and change your Personal Data by logging into the Versive Service and visiting your account profile page.
You may also send us an email at contact@versiveapp.com to request access to, correct or delete any Personal Data that you have provided to us. Versive cannot delete your Personal Data except by also deleting your user account. Versive may not accommodate a request to change information if Versive believes the change would violate any law or legal requirement or cause the information to be incorrect.
To verify a request to know, request to delete, and request to correct, we ask you to provide certain details related to your Versive account. Please note, if you do not have a Versive account we will not have enough information about you to verify your identity and respond to your requests, as we do not keep sufficient information necessary to re-identify and link you to a prior visit to the Versive Service where data may have been collected. As such, we will be unable to verify and honor your requests. You may designate, in writing or through a power of attorney (in accordance with local law), an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
If you delete your Messenger Contributions from the Versive Service, copies of your Messenger Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Versive Service users.
Certain additional rights specific to state law protections are set forth below in the section titled “State-Specific Disclosures”.
Data Security and Retention
Data Security
Versive has implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls. All user account data is encrypted in transit and at rest. Sensitive information like access tokens and keys are encrypted at the application level before they are stored in the database.
The safety and security of your information also depends on you. Where Versive has given you (or where you have chosen) a password for access to certain parts of the Versive Service, you are responsible for keeping this password confidential. Versive asks you not to share your password with anyone.
Please be aware that the Personal Data we collect is stored in the United States. If you are outside the United States, your Personal Data may be transferred to and maintained on servers or databases located outside your county, and Personal Data may be accessible to law enforcement and national security authorities in the United States.
Unfortunately, the transmission of information via the internet is not completely secure. Although Versive does our best to protect your Personal Data, Versive cannot guarantee the security of your Personal Data transmitted to the Versive Service. Any transmission of Personal Data is at your own risk. Versive is not responsible for circumvention of any privacy settings or security measures contained in the Versive Service.
Data Retention
Versive retains all data for as long as it is necessary for the purposes set out in this Policy, including to provide the Versive Service to you; to send you information related to the Versive Service, our products and services and your account; to conduct internal research, develop and improve new products and services; to exercise the choices and rights you have requested; to comply with our contractual obligations; to protect our legal rights and obligations, resolve disputes and enforce our Terms for Use and this privacy Policy; and to comply with legal and regulatory requirements.. Unless otherwise required by law, only Personal Data and other data that you provide to us, which has not been anonymized as De-identifed Data or pseudonymized, will be deleted in response to your request to delete your data. However, we may continue to retain data that you have requested for us to delete if required to comply with applicable law or to enforce the Terms of Use or this privacy Policy.
Changes to Our Privacy Policy
It is our Policy to post any changes Versive make to our privacy Policy on this page. If Versive make material changes to how Versive treat our users’ Personal Data, Versive will use commercially reasonable efforts to notify you through a notice on the Versive Service. The date the privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting the Versive Service and this privacy Policy to check for any changes.

State Specific Disclosures
Residents of certain jurisdictions have additional rights under applicable privacy laws. Please refer to the applicable subsections below that reference your jurisdiction of residence. We do not guarantee compliance with the privacy requirements of all jurisdictions, particularly given the narrow geography of currently permitted use: the United States (only). We are committed to upholding a high standard and retaining your trust. Accordingly, we will strive to timely update this Policy as additional privacy laws become applicable and as privacy laws are amended from time to time.
Your California Privacy Rights
If you are a California resident, California law may provide you with additional rights regarding our use of your Personal Information. These rights include the right to know whether we collected, sold, shared, or disclosed your Personal Information for a business purpose, the specific pieces of Personal Information we collected (the right to data portability), the right to delete your Personal Information, the right to correct inaccurate Personal Information, the right to opt-out of Personal Information sales or sharing Personal Information for cross-context behavioral advertising purposes, the right to limit sensitive Personal Information use and disclosures to specifically permitted purposes, and freedom from discrimination. At this time, Versive is not a covered business under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”). In the event that we become a covered business, we will provide you with all required disclosures and notices, including a more detailed description of your rights, a notice at collection, and all required opt-out notices.
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the Versive Service that are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. Alternatively, the law provides that a company may comply, as Versive does, by disclosing in its privacy policy that it provides consumers choice (opt in or opt out) regarding sharing personal information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice. As stated in this Policy, Versive provides you choice prior to sharing your Personal Data with third parties for their direct marketing purposes. If you do not opt-in or if you opt-out at the time we offer that choice, we do not share your information with that identified third party for its direct marketing purposes.
Colorado, Connecticut, Oregon, Texas, Utah, and Virginia
We set forth in this Policy the categories of personal data we process, the purpose for processing personal data, the categories of personal data shared, and the categories of third parties with whom personal data is shared. Residents of CO, CT, OR, TX, UT, and VA have certain privacy rights with respect to this data, as described below.
Access Your Information/Obtain Your Information/Data Portability (CO, CT, DE, IA, MT, NE, NH, NJ, OR, TX, UT, VA Residents) - You have the right to confirm whether we are processing your personal data and request to access such data, obtain a copy of your personal data, and, to the extent feasible, in a readily usable format to allow data portability. Your state may also provide you the right to request a list with certain additional information about certain third parties to which Versive may have disclosed your personal data.
Delete Your Information (CO, CT, DE, IA, MT, NE, NH, NJ, OR, TX, UT, VA Residents). You have the right to request the deletion of your personal data, subject to certain exemptions and exceptions.
Correct Your Information (CO, CT, DE, MT, NE, NH, NJ, OR, TX, VA Residents). You have the right to correct the personal data we hold about you.
Sensitive Data. If you are a CO, CT, DE, MT, NE, NH, NJ, OR, TX, or VA resident, to the extent Versive processes sensitive data, we will obtain your consent to the processing of any Sensitive Data (as defined by the applicable state law) before any such data is collected. You may also opt out using the methods to exercise your rights listed below in this section. If you are a IA or UT resident, you have the right to opt out of the processing of Sensitive Data, each as defined by the UT privacy law, to the extent that Versive processes any such data.
Right to Opt-Out of Profiling in furtherance of legal or similarly significant effects. Versive does not process personal data for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects.
Right to Appeal (CO, CT, DE, IA, MT, NE, NH, NJ, OR, TX, and VA Residents) - You have the right to appeal our decision relating to your request by contacting us as provided in the Policy.
Nevada
If you are a Nevada resident please note that we do not sell your personal data (or “covered information”) as defined in Nevada S.B. 220. However, if you are a Nevada resident, you may still submit an opt-out request, and if our practices were to change in the future, we would honor your request. Your request to opt out of the sale of your covered information must be submitted to the email address provided in the “Contact Us” section of the Policy with the subject line “Nevada Do Not Sell Request” along with your full name, street address, city, state, zip code, whether you are a former or a current subscriber/listener and a valid email address so that we can contact you if needed regarding your request. If you previously provided a phone number, including it will assist us in making sure we identify you as someone who wants to opt out. You may be required to take reasonable steps as we determine from time to time to verify your identity and/or the authenticity of your request. Note: in order to process a request from a former or current subscriber/listener, your email address must match the email address on your account.
Washington
Under Washington state law, consumers have the right to know about the collection, sharing, sale, and use of health-related data about them. Versive does not collect, share, sell, or use health-related data about consumers, as defined under the Washington My Health My Data Act.
